Terms and Conditions of Hire

For the purposes of this document Greenwich Yacht Club will be referred to as "GYC", the function rooms shall be referred to as "lettings" and any person/persons wishing to use the lettings facility shall be referred to as the "Hirer".

Part A – Accommodation

Set out below are the Terms and Conditions that are applicable to the hire and use of the lettings buildings at GYC. Please read these carefully as they will form part of the contract between GYC and the Hirer. PART B – PARTICULARS OF CONDITIONS OF HIRE

  1. Contracts For The Hire of the Lettings

  2. Contracts for the Hire of the Lettings shall be made in accordance with the following conditions:

    1. All bookings must be made in the name of the person or organisation intending to use the venue.
    2. The Hirer must complete and return the GYC application form within 10 days of provisionally arranging the hire of the lettings facilities.
    3. The Hirer must send the deposit specified by the GYC and the application form.
    4. There will not be a contract between the GYC and the Hirer until the GYC has sent a receipt for the deposit to the Hirer together with a copy of the application form.
    5. The Hirer will be invoiced for the balance of all charges up to 8 weeks before the date of the event.
  3. Cancellation of Contracts

  4. Contracts for the hire of the lettings may be cancelled at any time subject to the following conditions:

    1. Any cancellation made by the Hirer must be in writing.
    2. Any deposit paid by the Hirer shall be non refundable. All cancellations must be made in writing.
    3. If a cancellation is made the fee payable is: More than 6 months- deposit only, between 4 and 6 months- 25%, between 2 a months- 50%, between 1 and 2 months 75%, less than 1 month 100%. These are percentages of the total cost.
    4. The GYC may cancel a contract if the Hirer breach’s the conditions whether statutory or otherwise. This includes disorderly or unseemly conduct on the part of any person present at the function.
    5. If the GYC consider that the function is likely to be objectionable or undesirable before the date of the hire, they may cancel the contract.
    6. The GYC may cancel a contract at anytime should they require to use the lettings in an emergency or for any purpose in connection with the GYC’s business. In this eventuality, any charge paid will be refunded to the Hirer, but the GYC shall not be liable to pay any compensation.
    7. If the conditions are not complied with the GYC may terminate any contracts made between the GYC and the Hirer and the Hirer shall forfeit the sums paid under those contracts.
  5. Catering Services

  6. The following conditions shall apply where catering is provided:

    1. GYC has exclusive right to provide food and beverages at functions booked at GYC lettings facilities.
    2. The Hirer shall advise the GYC on how many persons will attend the function and shall advise on numbers for catering purposes. There will be a minimum requirement for catering and the Hirer will be liable for all costs.
    3. Catering must be provided at ALL functions

      NB No food, liquor nor non alcoholic beverages of any kind may be brought onto the premises without the authorisation of the GYC manager, who reserves the right to make additional charges.

  7. General Terms

  8. The following general terms apply to every contract for the hire of a GYC letting room.

    1. The hire charges for general events will be set out in a separate document to the Hirer and will relate to each individual function and requirements.
    2. Any matters regarding the hire and use of the GYC lettings, which are not referred to in this document , are prohibited unless permission is obtained in writing from GYC.
    3. The GYC reserves the right to revise the hire charges at any time.
    4. Persons under the age of 21 years of age are not permitted to hire any of the GYC’s lettings facilities.
    5. All scenery, decorations and other material erected by the Hirer, or brought into the letting rooms shall be adequately flame proofe to the equivalent of BS 3120 standard. The GYC representative on site will prohibit the use of any item that does not comply with this standard.
    6. No nails, screws, bolts, pins, thumbtacks or other such fixings shall be driven into any of the walls, floors, doors, ceilings, window or door frames or fittings of the premises or any other parts. No adhesive material is to be used for the display of posters or other materials. No placard, decoration, emblem, poster or advertising matter shall be exhibited on or outside the premises, except with the express prior consent in writing of the GYC.
    7. No gas or oil stoves, lamps, candles, tea lights, indoor fireworks or Compressed gas cylinders shall be brought into the premises.
    8. The Hirer shall not, for any purposes, treat or apply any substance whatsoever to any part of the floor of any of the GYC letting rooms.
    9. All Hirers of the letting rooms for Fayres, Exhibitions, Charity events etc must submit a floor plan a minimum of two weeks before the event showing the position of stalls, stands, gangways, etc, for the approval of GYC.
    10. Any licensing extensions that may be required for the sale of intoxicating liquor on site must be applied for and obtained by GYC Under no circumstances must the Hirer take it upon themselves to obtain this licence. GYC reserve the right to cancel any contract in breach of these terms at any time.
    11. All articles and clothing brought onto GYC premises are done so at the owners risk. GYC will accept no responsibility.
    12. The Hirer shall ensure that all persons in the letting rooms are wearing suitable footwear so as to prevent damage to the floors.
    13. No electrical fittings/fixtures or appliances in the lettings rooms must be Interfered with, altered or removed. Details of any electrical equipment to be used by any entertainers, discos or bands etc will have to have a PAT certificate, before its use will be permitted on GYC premises. Smoke machines, laser, strobe lighting and flash pots etc are also subject to these conditions. Any such equipment must not be used unless the Hirer has received approval, in writing, from GYC. Failure to do so will result in a breach of GYC regulations and contracts may be terminated.
    14. Only paper confetti or Rose petals can be placed on the tables for decorations. Metal/metallic confetti or sprinkles are strictly forbidden.
  9. Hirers Responsibilities

  10. The Hirer shall during the period of hire be responsible for the following matters:

    1. The efficient supervision of the guests including the control of children. The Hirer will be informed by the GYC representative on site as to the emergency and evacuation procedure for the premises.
    2. To ensure the safety of the premises and the preservation of good order and decency therein.
    3. That all exit doors shall be kept unfastened and unobstructed and immediately available for exit during the period of hire. No obstruction shall be placed or allowed to remain in any exit corridor or route.
    4. That in the event of any person acting in such a manner so as to cause an annoyance or inconvenience to other persons, the Hirer shall take all necessary steps with the offender to maintain good order.
    5. The Hirer shall not permit any animals other than guide dogs to be admitted to GYC lettings for any purpose, except with the specific consent in writing of the GYC and subject to such conditions as may be deemed necessary.
    6. Where considered necessary by GYC the Hirer must pay for such number of security as the GYC may consider necessary for the proper conduct of the function, traffic regulation or the protection of the GYC’s property.
  11. Hirers Breach of Condition

  12. If the Hirer fails to observe and perform any of the conditions contained in the contract of hire the GYC may recover from the Hirer any expenses incurred by the GYC securing such observance and performance.

  13. Right of Entry

  14. During the period of hire GYC flag officers or officers of the London Fire and Civil Defence Authority may enter any part of the premises to observe whether conditions are being observed or for any other purposes of their duties.

  15. Gaming

  16. (Including Bingo). No unlawful games or gaming shall take place on the Premises. Hirers wishing to use the premises for the playing of ‘Bingo’ shall sign an undertaking that this will be conducted strictly in accordance with the provisions of the Betting, Gaming and Lotteries Act 1966, and will not come within the scope of licensing under the Finance Act 1966. A form of undertaking is available from the GYC.

  17. Sub Letting

  18. A hiring, or the rights under any hiring granted, may not be assigned or sub-let.

  19. Loss or Damage to GYC and Private Property

    1. The Hirer shall be responsible for, and shall forthwith on demand, pay to GYC any expenses incurred by GYC in making good any damage to Letting rooms or any loss or damage to any fixtures, fittings or equipment, occurring during the period of, or arising out of the hire.
    2. The GYC shall not be responsible for any loss, or damage to, property of the Hirer, or other persons present during the hire arising from any cause whatsoever or for any loss due to break down of machinery or equipment, failure of electricity supply or other matter which may cause the letting rooms to be temporarily closed or the hiring to be interrupted or cancelled. The Hirer shall indemnify the GYC against any claim which may arise out of the hire or which may be made by any person present during the hiring in respect of any such damage.
  20. Copyright

  21. The Hirer shall indemnify the GYC against any infringement of copyright, which may occur during the period of hire.

  22. Cinematograph

  23. No cinematograph or projecting apparatus shall be used without the previous approval of the GYC. Application must be made six week before the date of the event stating the type of equipment and film to be used. Only films, which have a British Board of Film Classification Certificate, may be shown.

  24. Statutory and Other Regulations

  25. Hirers shall also observe all relevant provisions of the Public Health Acts and Children’s and Young Persons Act.

  26. Smoking Policy

  27. Hirers will observe that smoking is prohibited anywhere inside any of the GYC Buildings. GYC reserves the right to prohibit smoking anywhere on its premises, inside or out, wherever it is deemed to be necessary without notice.

  28. Licensing Hours

  29. The hours of permitted licensing at GYC are as follows:

    Mon-Sat 11.00am – 11.00pm

    Sun 12.00 pm – 10.30pm

    An additional half an hour shall be permitted for the drinking up of beverages.The Hirer and their guests will be expected to observe this rule and vacate the premises at the end of this permitted time.

    Any extensions to our normal licensing hours, that are required by the Hirer, must be made in writing to GYC no less than eight weeks before the event. In some cases it may be necessary for the Hirer to provide evidence to back up applications for extensions. There will be additional costs added for any extensions booked.

    When the sale of alcohol ends, All lights will be turned on throughout the function room and the entertainment/music will be stopped at the commencement of the drinking up period.
